Two claims, often pursued together

Texas law recognizes two distinct claims after a fatal accident. A wrongful death claim belongs to the surviving spouse, children, and parents, and compensates them for their own losses. A survival claim belongs to the deceased person’s estate and covers what they could have claimed had they survived, including medical and funeral expenses.
